TuneSolo General Terms of Use

• 1. Uso del Servicio
  • Elegibilidad.You must be at least 13 years of age to access or use the TuneSolo Service. If you are under 18 years of age (or the age of legal majority where you live), you may use the TuneSolo Service only under the supervision of a parent or legal guardian who agrees to be bound by these Terms. If you are a parent or legal guardian of a user under the age of 18 (or the age of legal majority), you agree to be fully responsible for the acts or omissions of such user in relation to the TuneSolo Service.
  • Acceso al Servicio. Subject to your compliance with these Terms, you are granted a non-exclusive, limited, non-transferable, freely revocable license to access and use the Service for personal use. TuneSolo reserves all rights not expressly granted under these Terms. Each person must have a unique account and you are responsible for any activity conducted on your account. Account credentials may not be shared or transferred. We reserve the right to block or suspend any Registered User’s use of the Site and the services on it without reason but expressly including if we think that they are violating these terms & conditions, legal liabilities (actual or potential), infringing someone else’s intellectual property rights, engaging in fraudulent, immoral or illegal activities, or for other similar reasons.
  • Restricciones de uso del Servicio. Usted no deberá, ni por sí mismo ni a través de un tercero, (i) alquilar, arrendar, vender, distribuir, ofrecer en una oficina de servicios, sublicenciar o de otra manera poner a disposición el Servicio o el Contenido con Licencia a ningún tercero (excepto según lo permitido por estos Términos); (ii) copiar, replicar, descompilar, realizar ingeniería inversa, intentar derivar el código fuente, modificar o crear trabajos derivados del Servicio, o cualquier parte del mismo; (iii) acceder al Servicio con fines de evaluación comparativa de rendimiento; (iv) acceder al Servicio con fines de construir o comercializar un producto competitivo; (v) utilizar el Servicio para almacenar o transmitir un virus o código malicioso; (vi) utilizar una red privada virtual (VPN) para eludir los precios basados en la geografía o el acceso al contenido; (vii) utilizar el Servicio para transmitir correos electrónicos no solicitados o participar en el envío de spam; (viii) utilizar cualquier forma de minería, extracción o raspado de datos en el Servicio y/o los contenidos disponibles en el mismo para aprendizaje automático u otros fines; o (ix) eludir las medidas que podamos utilizar para impedir o restringir el acceso al Servicio, incluidas, entre otras, las funciones que impidan o restrinjan el uso o la copia de cualquier contenido o impongan limitaciones al uso del Servicio o del Contenido Licenciado.   • Disponibilidad. • 2. Facturación

  TuneSolo offers a free and paid Service. Pricing may vary by location and will be based on the billing information you provide us at the time of purchase.

  • Suscripciones y renovaciones.If you are subscribing to TuneSolo, you can sign up for either a monthly, annual or lifetime subscription. Your subscription will automatically renew on a monthly or annual basis as applicable. You can cancel your subscription at any time. If you cancel your subscription, you will not receive a refund or credit for any amounts that have already been billed.
  • Impuestos Your subscription fees are inclusive of all taxes unless otherwise specified in an agreement with TuneSolo, within the Service or on an applicable invoice. Tax rates are calculated based on the billing information you provide and the applicable tax rate at the time of your subscription charge.
  • Cancelación. Puede dejar de usar el Servicio y/o cancelar su suscripción en cualquier momento enviándonos un correo electrónico. Si cancela su suscripción, no tendrá derecho a un reembolso de las tarifas ya pagadas.
  • Pruebas gratis. TuneSolo may offer you a free trial or pilot to allow you to try our Service. TuneSolo reserves the right to set eligibility requirements and the duration for free trials and pilots. Your access to the Service will cease if you do not enter into a paid subscription prior to the end of the pilot period.
  • Cambios en los precios. TuneSolo reserves the right to change its prices at any time. If you are on a subscription plan, pricing changes will not apply until your next renewal or thirty (30) days after notice, whichever is later.
  • Comunicaciones de facturación. You agree that TuneSolo may contact you at any time by email or other method with information relevant to your subscription, billing, and use of the Service.
• 3. Realimentación

  In the event that you provide us with any questions, comments, suggestions, opinions, observations, usage information, or feedback for TuneSolo App and Service, including ideas for improvements, enhancements and other changes (collectively the “Feedback”), you agree that we are the owner of such Feedback, and we are free to use it for our business purposes, including by incorporation into the Services and Software without any payment or attribution or other obligation to you. You warrant that you own all the rights and interests in and to the Feedback and you hereby assign all the rights and interests in and to the Feedback to TuneSolo.

  Ownership of the TuneSolo App and Service, and all content and materials contained therein other than any User Content (as defined below), are owned solely by us or our licensees and are protected by U.S. and international copyright laws. No title to or ownership of the Site, the App, the TuneSolo Service or any proprietary rights associated with them is transferred to you by these Terms. TuneSolo and our logos, our product or service names, our slogans and the look and feel of the TuneSolo Service are our trademarks and may not be copied, imitated or used, in whole or in part, without our prior written permission. All other trademarks, registered trademarks, product names and company names or logos mentioned on the TuneSolo Service are the property of their respective owners. Reference to any products, services, processes or other information by trade name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation by us.

• 6. Limitación de responsabilidad

  In no event shall either party’s aggregate cumulative liability hereunder (whether in contract, tort, negligence, strict liability in tort or by statute or otherwise) exceed the greater of (i) $100 USD or (ii) the subscription fees paid by you to TuneSolo during the twelve-month period preceding the event or occurrence giving rise to such liability. The foregoing limitations shall not apply to liabilities arising out of your indemnification obligations or your breach of the section entitled ‘restrictions on use of the service.’

  TuneSolo is not responsible for, and assumes no liability for, the contents of User Content.

• 7. Duración y terminación
  • Término.These Terms shall take effect the first time you access the Service and shall continue in full force and effect until i） if you are a paid subscriber, the expiration or termination of your subscription; or ii） if you are using TuneSolo’s free offering, when your account is deleted or terminated.
  • Infracciones. If TuneSolo, in its reasonable discretion, determines that you or your use of the Service, your User Content, or your Designs violate these Terms, TuneSolo may take one or more of the following actions: (i) delete the prohibited Downloaded Content; (ii) suspend your access to the Service; (iii) terminate and delete your account along with all Downloaded Content associated with that account (iv) permanently ban you from using the Service.

  • Supervivencia de los Términos.Sections titled "Term and Termination," "Billing," "TuneSolo’s Intellectual Property," "Limitation of Liability," "Indemnification," and more inclusive, shall survive any expiration or termination of these Terms.

Additionally, if you subscribe to TuneSolo, we collect details about your subscription like the type, duration, cost, and start date of your subscription, and we work with a third-party payment processor to collect and process your payment information.

TuneSolo is not responsible for the functionality or security measures of any third party.

  TuneSolo does not sell or rent the information we collect directly from you or about you from third parties with these third-party ad servers or ad networks for such parties’ own marketing purposes.

  The TuneSolo Privacy Policy does not apply to, and we cannot control the activities of, third-party advertisers. Please consult the respective privacy policies of such advertisers or contact such advertisers for more information.
